Prayer :- Writ Miscellaneous Petition filed under Article 226 of the Constitution of India, to Extend the ordinary leave granted to the petitioner's husband Nagarajan, S/o Karuppiah, a life convict prisoner (C.P No.5864) now confined under the Superintendent of Prison, Madurai, 3rd respondent herein, for an additional period of 10 days vide order dated WP(MD).No. 26432 of 2024 dated 11.11.2024 by considering the petitioners representation dated 02.12.2024. Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records of the impugned order passed by the 3rd respondent in No. E376527/tha.ku.2/2024 dated 26.09.2024 and quash the same and consequently directing the respondents to one month grant ordinary or emergency leave without escort to the petitioner's husband namely Nagarajan, S/o. Karuppiah convict Prisoner (CP. No. 5864) now confined under Central Prison, Madurai in light of the petitioner's father in law medical circumstances.
ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s. S. Srikanth, Advocate for the Petitioner and of Mr. A. Thiruvadi Kumar, Additional Public Prosecutor for the respondents, this Court made the following order:
