This petition has been filed to restore the C.M.P.(MD)No.9179 of 2022 in S.A.(MD)No.172 of 2021, to file.

2.Learned Counsel for the first respondent fairly states that he has no objection to restore the above C.M.P., since it was only dismissed for non-prosecution.

3.Accordingly, this petition is ordered.

4.Registry is directed to restore C.M.P.(MD)No.9179 of 2022 and list the same for hearing on 10.04.2026. In the meantime, counter, if any, shall be filed.
