ORDER : The Court made the following order :- The petitioner/A3, who was arrested and remanded to judicial custody on 1/4
08.04.2024 for the offences under Section 8(c) r/w 20(b)(ii)(c), 25 and 29(2)(a) of NDPS Act in C.C.No. 35 of 2024 on the file of the learned II Additional District Judge for EC and NDPS Act Cases, Thanjavur in Crime No.294 of 2023 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on search of a vehicle, 280 Kg of Ganja was seized. There are totally seven accused persons in this case and the petitioner was originally ranked as A5. On completion of investigation, the police report was filed and the case was pending before the Special Court for EC and NDPS Act cases, Thanjavur in C.C.No.166 of 2023. In this case, the petitioner was arrayed as A5. Since A2, A4 and A5 were absconding, the case was split up and the split up case was numbered as C.C.No.35 of 2024. In this split up case, the petitioner has been arrayed as A3. The trial was progressing in the parent case in C.C.No.166 of 2023. While so, the petitioner was secured and insofar as the petitioner is concerned, his case was clubbed along with the parent case in C.C.No.166 of 2023.
3. The learned Additional Public Prosecutor appearing for the respondent police submitted that the case is now at the stage of examination of the investigation officer. He further submitted that four previous cases are pending against the petitioner, out of which, two cases pertains to the offence under the NDPS Act. 4.Taking into consideration the facts and circumstances of the case and 2/4
considering the quantity involved in this case and also taking note of the fact that the petitioner was absconding in this case for quite some time and also taking note of the fact that the case is now at the stage of examination of investigation officer, this Court is not inclined to enlarge the petitioner on bail in this case. 5.In view of the above, this criminal original petition is dismissed and there shall be a direction to the learned Presiding Officer, Special Court for EC and NDPS Act cases, Thanjavur to dispose of the case in C.C.No.166 of 2023 within a period of three months from the date of receipt of a copy of this order. sd/- 08/01/2025 / TRUE COPY / 09/01/2025 Sub-Assistant Registrar Madurai Bench of Madras High Court, Madurai - 625 023.
