PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for records the impugned order in Na.Ka.No. 2342/88/Pa.O.Thi/2024 dated 05.08.2024 passed by the 2nd respondent quash the same and consequently direct him to accept the petitioners contributory pension scheme(CPS) retirement benefits pension proposal will be sent by the 1st respondent and disburse the same to the petitioner.

The petitioner was appointed as a Village Assistant on compassionate ground, in the year 2013 at Jangalpatti Village, Theni. He retired from service on 31.05.2024. The petitioner claims that he has rendered 10 years of service and therefore, he must be provided with contributory pension. The claim of the petitioner was denied by the Director and Chief Commissioner, Treasury Audit Department, Chennai, vide his proceedings in Na.Ka.No. 2342/88/Pa.O.Thi/2024 dated 05.08.2024 and the same is under challenge in this writ petition.

2.Today(06.01.2026), when this writ petition is taken up for hearing, the learned Special Government Pleader by referring to the authorization issued by the Chief Accounts Officer, Directorate of Treasuries and Accounts Pension and CPS Wing, Nandanam, Chennai submits that the Chief Accounts Officer has granted authorization for providing contributory pension to this petitioner, by his proceedings in Ref.No.3678062/CPS/2025, dated 30.12.2025. Therefore, according to the learned Special Government Pleader, in view of the authorization provided by the Chief Accounts Officer, the case of the petitioner for the contributory pension would be considered positively, within a reasonable time. A copy of the authorization, dated 30.12.2025 is placed before this Court. 3.In view of the subsequent development and recording the submissions of the learned Special Government Pleader, this writ petition is closed with a direction to the respondents to ensure that the eligible contributory pension to this petitioner as sanctioned by the Chief Accounts officer shall be disbursed to this petitioner, 3/5

within a period of eight weeks from the date of receipt of a copy of this order. No costs. Consequently, connected Miscellaneous petitions are closed.
