O R D E R

The Petitioner, who was serving as Personal Assistant to the District Collector of Virudhunagar District, was placed under suspension vide G.O. (2D).No.35, Rural Development Panchayat Raj Department, dated 30.05.2024, on the contemplation of serious charges. However, no charge memo has been issued to the petitioner till date.

2. This writ petition was entertained by this Court on 19.12.2024. When this writ petition was taken up for hearing today i.e., 16.12.2025, the learned Government Advocate appearing for the respondents submits that the petitioner died on 30.11.2025. He also confirmed that no charge memo has been given to the petitioner.

3. Since the petitioner died and no charge memo has been issued as against him, nothing is to be adjudicated in this writ petition. Accordingly, this Writ Petition is closed. The petitioner was not allowed to retire on attaining the

age of superannuation and issued with the impugned suspension order. Though the suspension order was issued in the year 2024, he was not issued with any charge memo and therefore, the respondents are directed to disburse the retirment benefits due to the petitioner to his legal heirs. No costs.
