PRAYER:Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for the 1/5

records pertaining to the impugned order passed by the second respondent in his proceeding dated 26.06.2024 in TN-520240214727 and quash the same as illegal and consequently direct the second respondent. For Petitioner : Mr.M.Ramachandran For Respondents : Mr.J.Ashok, Additional Government Pleader

ORDER

(Order of the Court was made by J.NISHA BANU, J.) Heard Mr.M.Ramachandran, learned counsel appearing for the petitioner and Mr.J.Ashok, learned Additional Government Pleader for respondents.

2. The petitioner has submitted an application for grant of Community Certificate to her before the second respondent. The said application was rejected on the basis of the report submitted by the Anthropologist, which has been referred to in the impugned order. Challenging the same, the petitioner has filed this writ petition.

3.The learned Additional Government Pleader appearing for the respondents submitted that in terms of G.O.(Ms)No.147, Revenue [RA-3(2)] Department, dated 17.03.2016, against the order of rejecting the application 2/5

seeking community certificate by the Revenue Divisional Officer, there is a provision of appeal before the District Collector and thereafter, before the State Level Vigilance Committee. The petitioner without availing the same, has filed this writ petition.

4.In view of the above submission, this writ petition is dismissed. The petitioner is directed to file an appeal against the order of rejection made by the second respondent before the first respondent/District Collector. The second respondent is directed to serve a copy of the order of rejection and the report of the anthropologist to the petitioner forthwith. No costs. Consequently, connected miscellaneous petition is closed.
