Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 4 to remove the encroachments made by the fifth respondent on the pathway in Survey No. 563/1 and 563/16 of Vaiyampatty Village, Manapparai Taluk, Tiruchirappalli District and maintain the common well in Survey No. 563/2 of Vaiyampatty Village, Manapparai Taluk, Tiruchirappalli District as clean and useful based on the representations dated 01.10.2024, 03.10.2024 and 05.10.2024 given to the respondents 1 to 4.

ORDER

Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 4. 2.The petitioner alleges that there are encroachments in the petition mentioned survey number.

3.The learned Additional Government Pleader clarifies that Survey No.563/1 has been classified as "Cart track" and Survey No.563/16 have been 2/4

classified as "Natham / Manai". Since both the survey numbers are not water bodies, the question of maintaining the writ petition will not arise at all. 4.This writ petition stands dismissed. There shall be no order as to costs.
