ORDER

This Criminal Original Petition has been filed to direct the respondents 1 to 2 to transfer the investigation in Crime No.1076 of 2023 under sections 120(B), 406,420 and 380 of IPC on the file of the fourth respondent to some other investigating agency.

When the matter is taken up for hearing today, the learned Government Advocate (Crl.Side) appearing for the respondents 1 to 4 would submit that already investigation was completed and filed referred charge sheet before the learned Magistrate and it is pending before the Magistrate, in view of the same this petition is liable to be dismissed. 2/5

3. In view of the submission made by the learned Government Advocate(Crl.side) that investigation was already completed no further order is required in this case. If any defects in the investigation and in the final report then the petitioner can challenge the same in the manner known to law. Since the final report is pending before the learned Magistrate it is not appropriate to pass any further orders in this case at this stage.
