PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for a Writ of Mandamus directing the respondents to grant family pension to the petitioner on the death of the petitioner's mother Kulanthai Theras (Pension Payment Order No.T58050) by following G.O(Ms).No.29 dated 31.01.2013 and by considering the petitioner's representation dated 26.04.2017 and 20.11.2024 within the stipulated time.

ORDER

The instant writ petition has been filed seeking a mandamus for disbursement of family pension to the writ petitioner on the death of her mother Kulanthai Teras by following G.O(Ms).No.29, dated 31.01.2013 by considering the petitioner's representation.

2.According to the learned counsel for the writ petitioner, her mother was working as a teacher in CSI Junior Basic School and after attaining superannuation, she was receiving pension. She passed away on 15.01.2015. It is

further contended that the petitioner is the eldest daughter of the deceased employee and she is a spinster and not having any other source of income. Therefore, according to her, she is eligible to receive family pension. The petitioner has given a representation to the concerned authority and filed the present writ petition.

3.When the writ petition came up for admission, the learned Government Advocate appearing for the respondents had contended that the petitioner has to appear before the authority and sign in the proper application form so that it could be forwarded to the concerned authority. The petitioner has appeared before the fourth respondent and has signed the family pension application form. 4.The learned Government Advocate, on instruction, submits that the fourth respondent would forward the same to the second respondent on or before 07.02.2025. On receipt of the same, the second respondent is directed to forward the said application to the first respondent within a period of eight (8) weeks from the date of proposal from the second respondent. 5.With the above said observations, this writ petition stands disposed of. No costs.
