ORDER

This Writ Petition has been filed for issuing a writ of mandamus to direct the first respondent herein to pass an order on the representation submitted by the petitioner herein dated 01.03.2021 on the light of the communication of the second respondent dated 01.08.2023 within the time frame fixed by this Court.

2.By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself.

3.Though the Writ Petition is filed for issuance of a Writ of Mandamus to give a positive direction to the respondents, the learned Counsel for the petitioner would submit that the petitioner would be satisfied, if a direction is issued to the first respondent to consider the representation of the petitioner and pass appropriate order within a time stipulated by this Court.

4.Having regard to the limited scope of prayer, that is now sought before this Court by the learned Counsel for the petitioner, without 2/4

expressing any opinion on the merits of the petitioner's case, there shall be a direction to the first respondent to hold an enquiry on the representation made by the petitioner seeking cancellation of patta standing in the name of the third party and pass appropriate orders, after affording on opportunity of personal hearing to the petitioner including the private individuals/rival claimants, on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. 5.With the above directions, the Writ Petition is disposed of.
