Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to disburse the petitioner's difference amount of Gratuity, Earned Leave and Surrender Leave Salary along with 6% interest on the basis of 7th Pay Commission with effect from 01.01.2016 to till the date of payment of the said monetary benefits to the petitioner within a stipulated time frame as fixed by this Court.

O R D E R

The instant writ petition has been filed by a retired employee of the respondent Transport Corporation, seeking a Mandamus to direct the respondents to disburse the difference amount of Gratuity, Earned Leave and Surrender Leave Salary along with 6% interest on the basis of 7th Pay Commission.

2. A perusal of the records indicates that the petitioner had attained superannuation on 30.04.2017. The 7th Pay Commission came into force on 01.01.2016 itself. However, it was implemented only on 01.04.2018. The petitioner's terminal benefits were released based on the 6th Pay Commission benefits. Hence, the petitioner has sent a representation to the respondents on 07.10.2024, seeking to pay the difference in the monetary benefits and thereafter, has filed the present writ petition.

3. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents. 2/4

Considering the above said facts, the respondents herein are directed to disburse the eligible amount to the writ petitioner based upon the 7th Pay Commission benefits along with interest 6% per annum, from the due date, till the date of disbursement, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs.
