ORDER

The petitioner has filed a complaint before the learned Judicial Magistrate, Theni, under Section 156(3) Cr.P.C. as against the private 1/4

respondents in Crl.O.P.(MD)No.9876 of 2024. The learned Judicial Magistrate has also referred the complaint filed by the petitioner for conducting an investigation. The respondent Police has conducted a preliminary investigation and found that the complaint does not have any material attracting a commission of offence and to register a case. Accordingly, they have filed a report before the learned Judicial Magistrate on 11.11.2024.

2. This Court, by order dated 04.07.2024, in Crl.O.P.(MD)No.9876 of 2024, issued a direction to the respondent Police to complete the enquiry as directed by the learned Judicial Magistrate within a period of two weeks.

3. It appears that the copy of the order passed in Crl.O.P.(MD)No. 9876 of 2024 reached them only in the month of August 2024 and they have filed a report in the month of November 2024.

4. Though there is some delay on the part of the respondent Police in conducting the enquiry on the complaint of the petitioner, which has 2/4

been forwarded by the learned Judicial Magistrate in the month of March 2024, this Court is inclined to close the contempt petition, by considering the scope in the contempt proceedings.

5. Accordingly, this Contempt Petition is closed. The petitioner is at liberty to workout his remedy in the manner known to law. 28.01.2025 ogy NCC : Yes / No.
