ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 296(b), 132, 303(2) of BNS and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.404 of 1/3

2024 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the accused persons were found illegally transporting 2 units of river sand. There are totally three accused persons in this case and the petitioner is arrayed as A1.

3. The learned Government Advocate (Crl. Side) would submit that the final report will be filed as early as possible since the investigation has been completed.

4. Considering the earlier order passed by this Court and considering the fact that the river sand has been seized and the vehicle has also been seized and also considering the fact that A2 was arrested and enlarged on bail and A3 was granted anticipatory bail and the investigation has been completed and the petitioner is going to be shown as absconding accused, no further orders are required to be passed in this petition.

5. Accordingly, this Criminal Original Petition is closed and if the petitioner is shown as absconding accused, he can always surrender before the Court and seek for bail.
