ORDER
The petitioner arrayed as A5 has filed this petition to quash the impugned final report in C.C.No.13 of 2010 filed for the offence under 1/11
Sections 147, 148, 294(b), 323, 324 and 506(2) IPC, on the file of the learned Judicial Magistrate, Karaikudi.
2. The allegation is that on account of wordy quarrel, the petitioner along with others had abused the defacto complainant, attacked him with hands and sticks and thus committed the aforesaid offence.
3. Though the quash petition has been filed by only one of the accused out of five accused, the defacto complainant has no objection to quash the C.C.No.13 of 2010 against all the accused.
4. It is also seen that the present defacto complainant/second respondent herein is also an accused in C.C.No.56 of 2024 which culminated from the FIR lodged by one of the accused, namely Muthumanikandan in C.C.No.13 of 2010. However, the accused persons in C.C.No.56 of 2024 in which the defacto complainant is an accused, have not filed a formal quash petition. Therefore, the learned counsel for the second respondent/defacto complainant seeks permission to file a quash petition against C.C.No.56 of 2024.

The second respondent/defacto complainant in this case and the said Muthumanikandan/defacto complainant in C.C.No.56 of 2024 filed a compromise affidavit dated 17th September, 2025 and in the affidavit, both of them have stated that both the cases may be quashed in view of the compromise and the scanned copy of the affidavits read as follows: 3/11

Today, the second respondent/defacto complainant in this petition is present and the defacto complainant in C.C.No.56 of 2024, the abovesaid Muthumanikandan is also present today and they are identified by Mr.K.R.Ambalavanan, SSI, Alagappapuram Police Station, Sivagangai District and both of them confirmed the compromise as stated in their affidavits.
7. This is a case and counter case and the defacto complainants in both cases have no objection in quashing the proceedings in C.C.No.13 of 2024 and C.C.No.56 of 2024. Considering the nature of allegations and the relationship between the parties, this Court is of the view that no useful purpose would be served in keeping the final reports pending trial.
8. In view of the affidavit filed by the defacto complainant/Muthumanikandan in C.C.No.56 of 2024, though there is no formal petition filed by the accused persons, the proceedings in C.C.No.56 of 2024, is also liable to be quashed.

9.Accordingly, the proceedings in C.C.No.13 of 2024 and C.C.No.56 of 2024 on the file of the learned Judicial Magistrate, Karaikudi, are quashed and this Criminal Original Petition is allowed. Consequently, connected miscellaneous petitions are closed.
