ORDER : The Court made the following order :- The petitioner /3rd accused, who was arrested and remanded to judicial custody on 09.10.2024 for the alleged offence under Sections 8(c), 20(b)(ii)(C), 25 and 29(1) of 1/3

the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act) in Crime No.395 of 2024, seeks bail.

2. This Court carefully considered the submissions made by the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent and also went through the counter filed by the respondent police. 3.The petitioner has been arrayed as A3 in this case and he is said to have travelled in the car along with A1 and A2 and the petitioner was the driver of the car. Totally 50 kgs of kanja has been seized from the car and the investigation is pending. For the present, this Court does not find any ground to enlarge the petitioner on bail in light of the twin conditions to be satisfied under Section 37 of NDPS Act. In view of the same, the petitioner has to necessarily await for the completion of investigation and filing of police report. It is left open to the petitioner to revive his claim by placing relevant materials before the Court.

4.In view of the above, this Criminal Original Petition stands dismissed for the present.
