PRAYER: Civil Revision Petition is filed under Article 227 of the Constitution of India to call for the records pertaining to the order passed by the Family Court, Karur in I.A.No.2 of 2024 in H.M.O.P.No.417 of 2024 dated 12.11.2024 and to set aside the same as illegal.

ORDER
This Civil Revision Petition has been filed to set aside the order passed by the Family Court, Karur in I.A.No.2 of 2024 in H.M.O.P.No.417 of 2024 dated 12.11.2024.

2. The revision petitioner is the wife and the respondent is the husband. The petition in H.M.O.P.No.417 of 2024 was filed by the respondent / husband before the trial Court seeking a decree of divorce. Pending the said H.M.O.P., the petitioner filed I.A.No.2 of 2024 seeking interim maintenance. The said application was opposed by the respondent. By order dated 12.11.2024, the trial Court dismissed the said petition. Aggrieved by the same, the petitioner has filed the present Civil Revision Petition.
3. The learned counsel appearing for the petitioner submitted that the petitioner is incurring regular medical expenses and has no independent source of income. Hence, it was prayed that this Court may grant interim maintenance to the petitioner.
4. The learned counsel appearing for the respondent submitted that a sum of Rs.14,00,000/- was earlier deposited in the name of the petitioner and the interest accruing from the said amount would be sufficient to meet her needs.
5. In reply, the learned counsel for the petitioner submitted that although the said sum was initially deposited in the petitioner's name, it has since been transferred to the name of the parties' daughter, and the petitioner has no access to the funds or the interest accrued thereon. 2/4
6. Considering the submissions of both parties and the circumstances of the case, this Court is of the view that the petitioner is entitled to some relief by way of interim maintenance. Accordingly, the respondent is directed to pay a sum of Rs.5,000/- (Rupees Five Thousand only) per month as interim maintenance to the petitioner, payable on or before the 7th day of every English calendar month, commencing from the month of August 2025, until the disposal of H.M.O.P.No.417 of 2024.
7. In view of the above, the Civil Revision Petition stands disposed of. No costs.
