PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the second respondent to conduct enquiry as expediously as possible on basis of the communication given by the 1st respondent, dated 18.10.2024 to enquire and to submit report and subsequently directing the 1st respondent to rectify the error made in entries in Patta No.765 for properties under S.No. 2671/21, situated at Perungudi II, Radhapuram, Tirunelveli District by granting individual patta for the petitioner's property which was erroneously joined to the Patta granted in favour of the 3rd respondent by considering the petitioner's representation 1/4

dated 25.09.2024 and 12.11.2024 within a time frame as may be fixed by this Court.

ORDER

The Writ Petition has been filed seeking a direction to the first respondent to rectify the error crept in Patta No.765 in S.No. 2671/21, situated at Perungudi II, Radhapuram, Tirunelveli District. 2.By consent of both parties, the Writ Petition is taken up for final disposal at the stage of admission itself.

3.When the matter is taken up for admission, the learned Government Advocate submitted that based on the proceedings of the Revenue Divisional Officer, a communication was sent to the Tahsildar, namely, the second respondent, to hold an enquiry and to send a report. The said communication was forwarded by the first respondent to the second respondent on 18.10.2024.

4.Considering the submission made by the learned Government Advocate, the second respondent is directed to conduct an enquiry and submit a report to the first respondent and on such report, the first respondent shall pass appropriate orders on merits and in accordance with law within a period of eight weeks from the date of receipt of the report from the second respondent.

5.With the above directions, the Writ Petition is disposed of. No costs.
