ORDER

The above petition has been filed seeking orders to condone the delay of 441 days in filing the appeal, challenging the award dated 16.06.2023 passed in M.C.O.P.No.308 of 2022 on the file of the Motor Accident Claims Tribunal / Principal District Court, Karur.

2. No representation for the first respondent.

3. Heard the learned counsel appearing for the petitioners and the learned counsel appearing for the second respondent.

4. The learned counsel appearing for the second respondent would submit that if the petitioners are waiving interest for those delay periods, they are having no objections to condone the delay and he has also made an endorsement to that effect.

5. The learned counsel appearing for the petitioners would also agree for the same.

6. Considering the above, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to number the appeal, if it is otherwise in order. The petitioners / claimants are not entitled to interest for the delayed period.
