ORDER : The Court made the following order :- This Criminal Original Petition has been filed by the petitioner on 19.12.2024 under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) praying to grant bail.
2. The petitioner/ accused was arrested and remanded to judicial custody on 18.02.2024 for the alleged offences punishable under Sections 8(c), 20(b)(ii)(c), 29(1) and 25 of Narcotic Drugs and Psychotorpic Substance Act, 1985 in Crime No.03 of 2024 on the file of the Nagapattinam Police Station (in Crime No.09 of 2024, before the Vettakaraniruppu Police Station).
3. The case of the prosecution is that on 18.02.2024 the respondent police received a secret information based on which, conducted a raid at about 06.15 a.m., near the house of one Malarkodi. The accused persons were found in possession of 364 Kg of Ganja. Hence the case.
4. Mr.K.Kumaravel, the learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner has been in judicial custody since 18.02.2024 and he is ready to abide by any condition to be imposed by this Court. He therefore prayed to grant bail to the petitioner. 2/4
5.Mr.R.Meenakshi Sundaram, the learned Additional Public Prosecutor appearing for the respondent police, submitted that the trial court posted the matter on 04.02.2025 for examination of the witnesses. He further submitted that the petitioner was found in possession of 364 Kg of Ganja, which is a huge quantity. Accordingly, he prayed to dismiss this Criminal Original Petition.
6. Heard on both sides. This Court has perused the records. 7.Considering the quantity of the contraband (i.e.364 Kg) and also considering the stage of trial, this Court is of the view that if bail is granted to the petitioner, the petitioner may abscond and the possibility of absconding is more. Hence, this Court is not inclined to enlarge the petitioner on bail. Accordingly, this criminal original petition is dismissed.
