ORDER

This Criminal Original Petition has been filed to direct the respondent to conduct enquiry and complete the investigation and file 1/4

final report in Crime No.252 of 2023 on the file of the respondent within the stipulated time as fixed by this Court.

2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. side) appearing for the respondent. 3.The learned Government Advocate (Crl. Side), on instructions, would submit that investigation was conducted in Crime No.252 of 2023 and three witnesses have been examined and later, it was closed as a 'mistake of fact' on 02.02.2024. He fairly submitted that RCS notice is not yet served to the petitioner.

4.Recording the same, this Criminal Original Petition is disposed of. However the respondent police is directed to serve RCS notice to the petitioner and on receipt of the RCS notice, the petitioner is at liberty to file a protest petition before the concerned jurisdictional Magistrate.
