PRAYER :- For Anticipatory Bail in Crime No. 73 of 2024 on the file of the respondent Police. ORDER : The Court made the following order :- The petitioner / Accused, who apprehends arrest at the hands of the respondent Police for the offences under Sections 329(4), 115(2), 303(2), 351(2) and 49 of BNS Act r/w Section 4 of TNPHW Act in Crime No.73 of 2024 on the file of the respondent Police, seeks anticipatory bail.

2. When the matter was taken up for hearing today, the learned Government Advocate (Criminal Side) appearing for the respondent Police submitted that the petitioner has already been granted station bail on 13.11.2024.

3. The learned counsel for the petitioner submitted that the petitioner is a Government employee and he has been called for an enquiry by issuing notice under Section 35 of BNSS. Therefore, the petitioner is apprehending arrest.

4. In the considered view of this Court, the fact that the respondent Police have resorted to procedure under Section 35 of BNSS only shows that the respondent Police are not inclined to arrest the petitioner. That apart, the petitioner was also given station bail on 13.11.2024.
