ORDER

This petition has been filed by the petitioners / Accused No.1 - 4 to call for the records relating to the C.C. No. 1318 of 2024 on the file of the learned Judicial Magistrate, Additional Mahila Court, Madurai and to quash the same.

2. The prosecution case is that due to matrimonial dispute between the petitioners and the defacto complainant, the defacto complainant / second respondent herein lodged a complaint before the first repondent. Based on the said complaint, FIR has been registered in Crime No.7 of 2023 for the offences under Sections 498(A), 406, 294(b) and 506(1) of the Indian Penal Code, 1860 and thereafter, the matter has been elaborately investigated and after investigation, the final report has been filed as against the petitioners. Now the case is pending for trial. At this stage, the petitioners have filed this quash petition.

3. When the matter was taken up for hearing, the learned Counsels on both sides represented that the matter has been amicably settled between the parties and they have entered into a compromise and the same was filed before this Court.

4. The defacto complainant and all the accused are present and the defacto complainant represented that she entered into a compromise as they are family members. A compromise memo, dated 25.02.2025 signed by the parties, is also filed before this Court.

4. This Court has perused the terms of the compromise memo dated 25.02.2025.

5. Considering the nature of the offences and the relationship between the parties and they have also entered into a compromise, it is appropriate to allow this petition.

6. In view of the above said compromise and considering the nature of offences, this Criminal Original Petition is allowed and the pending proceedings in C.C.No.1318 of 2024 on the file of the learned Judicial Magistrate, Additional Mahila Court, Madurai is quashed. The compromise Page no.3/5
