PRAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari calling for the records pertaining to the impugned order passed by the 1st respondent in his proceedings in Na.Ka.No.U1/ 22295/2024 dated 23.10.2024 and quash the same as illegal and unconstitutional. O R D E R

When the matter came up for consideration on an earlier occasion, the learned counsel appearing for the petitioner submitted that the petitioner is ready to pay the amount in terms of the order passed in the proceeding in Na.Ka.No.U1/ 22295/2024 dated 23.10.2024, but the respondent No.4 with malafide intention initiated proceedings under the Revenue Recovery Act. This Court having taken note of the same, adjourned the matter to enable the

petitioner to pay the said amount, while directing the maintenance of status quo in respect of the impugned proceedings.

Today, when the matter is taken up for consideration, the learned counsel appearing for the petitioner placed before this Court a copy of the Demand Draft bearing No.222100 for an amount of Rs.3,55,546/- being the amount due under the proceedings dated 23.10.2024 and further submitted that the said demand draft would be submitted before the respondent No.2 for transmitting the same to the respondent No.3 herein.

3. In the light of the above, there is no need to adjudicate the Writ Petition on merits and accordingly, this Writ Petition is disposed of directing the petitioner to handover the above said Demand Draft for a sum of Rs.3,55,546/- to the respondent No.2 within three days from today and on receipt of the said Demand Draft, the respondent No.2 shall forward the same to the respondent No.

3. In turn, the respondent No.3 shall take all necessary steps to disburse the aforesaid amount in favour of the respondent No.4, within a further period of

two weeks. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
