PRAYER: Contempt Petition is filed under Section 11 of the Contempt of Courts Act, to punish the respondents herein for their wilful disobedience of the order of this Court in W.P(MD) No.20000 of 2024, dated 22.08.2024.

ORDER

The present Contempt Petition has been filed alleging violation of the orders of this Court dated 22.08.2024 made in W.P(MD) No.20000 of 2024, has not been complied with, wherein, the respondent Transport Corporation was directed to confer the eligible benefits upon the writ petitioner based upon the 12(3) Settlement dated 04.01.2018.

2. The respondent Transport Corporation has filed an affidavit. Paragraph No.6 of the affidavit is extracted as follows: "6. I humbly submit that the respondent strictly adhered to the terms of 12(3) settlement which was arrived on 04.01.2018 and as per the order of Hon'ble Court. When the facts are 2/5

being so, the petitioner misconceived the same and filed this present contempt petition No. 162/2025 claiming arrears of pay for 62 months from 21.04.2012 to 30.06.2017 which is not agreed in the settlement."

It is the contention of the learned Standing Counsel appearing for the respondent Transport Corporation that the eligible benefits arising out of 12(3) Settlement, dated 04.01.2018 have already been conferred upon the writ petitioner even prior to the filing of the writ petition and therefore, he is not entitled to any further monetary benefits from the Transport Corporation.

4. In view of the above said facts, this Contempt Petition stands closed with liberty to the petitioner to workout his remedy in the manner known to law.
