This Criminal Original petition has been filed to direct the Respondent Police to expedite the investigation in Crime No.19/2019, dated 14.10.2019 and file a final report.
2. When the matter is taken up for hearing today, the learned Additional Public Prosecutor would submit that in this case though investigation has been completed by the respondent Police, it is sent for approval of Public Prosecutor even in the year 2021. 3.It is surprising for this Court that the case is pending from the year 2021 to 2024 only for getting opinion from the Public Prosecutor, which is unwarranted, since this Court has already held that opinion of Public Prosecutor is not mandatory.
4. In view of the same, the respondent police is directed to file a final report before the concerned Court without any delay, preferably on or before 28.01.2025. With the above directions, this Criminal Original Petition stands disposed of.
5.Post the matter for reporting compliance post on 29.01.2025. 06.01.2025 Note:
