ORDER

This petition has been filed to condone the delay of 446 days occurred in representing the returned papers in the above said appeal. 2.This appeal has been filed by the plaintiff in O.S.No.77 of 2018 against the dismissal of the suit by the Judgment and Decree dated 30.09.2021 by the learned Additional District & Sessions Judge, Mahila Neethimandram (Fast Track Mahila Court), Theni, with a petition to condone the delay. Due to some defects the papers were returned by the Registry. To represent the rectified papers there is some delay occurred. To condone the above said delay, this petition has been filed. 3.The above said suit was filed by the plaintiff seeking partition of the suit properties and for declaration.

4.Considering the facts and circumstances of the case and accepting the reasons stated in the accompanying affidavit, this Court is inclined to allow this application on condition.

5.Accordingly, the petitioner is directed to pay a sum of Rs.5,00/- (Rupees Five Hundred only) to the Women Lawyers Association attached to the Madurai Bench of Madras High Court, Madurai, within a period of ten days from the date of receipt of a copy of this order.

6.On the above said condition, this civil miscellaneous petition stands allowed. Failing which this petition shall stand dismissed automatically without any reference to this Court.
