ORDER

This Civil Revision Petition has been filed against the fair and decreetal order in IA.No. 351/2022 in HMOP No. 210/2022 dated 01.10.2024 on the file of 3rd Additional Sub Court, Madurai.

2. The petitioner is the husband and he filed a petition for divorce, in which, the first respondent/wife has filed a petition in IA No.321/2022 claiming interim maintenance. The trial Court ordered a monthly maintenance of Rs.40,000/-.

Aggrieved by the same, the petitioner/husband is before this Court.

3. The learned counsel for the petitioner would submit that since the matrimonial life ran into rough weather, the petitioner/husband filed a 2/5

petition for divorce, in which, the wife filed an interlocutory application claiming maintenance and the trial Court accordingly granted Rs.40,000/- The learned counsel would submit that since the petitioner is unemployed, the maintenance awarded may be reduced.

4. The learned counsel for the respondents, however, would contend that at present, the petitioner is working in Singapore and earning a sum of Rs.7 lakhs per month, out of which, Rs.40,000/- interim maintenance ordered is very meagre and prays for dismissal.

5. I have considered the rival submissions and perused the materials available on record.

Considering the facts and circumstances of the case and considering the fact that the petitioner is employed in Singapore and earning considerably and the first respondent/wife has to take care of not only herself but also the two children born out of the wedlock, the maintenance awarded by the trial Court is found to be just and reasonable, which need not be interfered with. 3/5

7. Accordingly, the Civil Revision Petition is dismissed. However, the petitioner shall deposit the entire arrears within a period of four weeks from the date of receipt of a copy of this order and continue to pay the maintenance of Rs.40,000/- as ordered by the trial Court, every month, ie., on or before 7th of every month without fail. In case of default in paying the maintenance, the first respondent is at liberty to proceed in accordance with law. No costs. Consequently connected Miscellaneous Petition is closed.
