ORDER

This contempt case has been filed complaining willful disobedience of the respondent in implementing the order dated 04.06.2024 in W.P.(MD)No.2578 of 2024 passed by this Court.

2. While disposing the said writ petition, this Court directed the first respondent therein, to consider the petitioner's representation dated 23.01.2024 on its own merits and pass appropriate orders in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

3. According to the learned counsel for the petitioner, the representation of the petitioner was not considered and order was not passed, within the time stipulated by this Court.

4. On the other hand, the learned counsel appearing for the respondent submits that after receipt of the copy of the order in the writ petition, the respondent informed the learned counsel for the petitioner,

in reply to his notice, that in view of the order passed by this Court on 28.07.2023 in W.P(MD).Nos.18228, 18229 and 18230 of 2023, the request of the petitioner made in his representation could not be considered. Even thereafter, the present contempt case is filed. He further submits that the Officer, who is impleded as respondent in this contempt case, retired from service on 31.03.2025. However, the present Director, Tamil Nadu Fire and Rescue Services Department, issued proceedings in RC.No.1425/B5/2024 dated 07.03.2025 informing the petitioner that in view of the pendency of the above writ petitions before this Court, they are not in a position to promote him to the post of Assistant District Officer formally/gratually.

Having regard to the submissions of both sides, it appears that the representation of the petitioner dated 23.01.2024 has been considered by the respondent in compliance of the order dated 04.06.2024 in W.P(MD).No.2578 of 2024 and the same was communicated to the petitioner's counsel vide letter dated 21.10.2024.

6. In view of the above factual position, in my considered view, no further adjudication is required in this petition.
