PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondent to disburse the balance gratuity amount of Rs.99,914/- and interest of Rs.52,694/- totally Rs.1,52,518/- which is due to the petitioner by complying with directions issued in P.G.No.137 of 2023, and vide circular in Na.Ka.No.22735/2018/I1, dated 13.01.2020, issued by the Commissioner H.R.and CE within time stipulated by this Court.

ORDER

The present Writ Petition has been filed by the Beneficiary of the order passed by the Controlling Authority under the Payment of Gratuity Act, 1972, Tirunelveli, in P.G.No.137 of 2023, dated 06.09.2024, seeking a mandamus as against the respondent to disburse the same as per the said order. 2.It could be seen from the records that the order has been passed on 06.09.2024, and the period for filing an appeal has got lapsed. In such circumstances, there cannot be any defence to the respondent Temple in disbursing the amount.

3.In view of the above said facts, the respondent is directed to comply with the order passed by the Controlling Authority, dated 06.09.2024, and disburse the amount as per the order of Controlling Authority in P.G.No.137 of 2023, dated 06.09.2024, within a period of 12 (twelve) weeks from the date of receipt of a copy of this order.

4.With the above said observations, this Writ Petition stands disposed of. No costs.
