The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 29 days in filing the appals against the judgment and decree, dated 13.09.2023 in A.S.No.73 of 2019 on the file of the Sub Court, Tiruchendur, confirming the judgment and decree, dated 31.03.2011 in O.S.No.156 of 2009 on the file of the Principal District Munsif Court, Tiruchendur.

2. Despite receipt of notice, the respondent has not turned up.

3.Heard the learned counsel for the petitioners and also perused the records.

4.Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to take the appeal on file, if it is otherwise in order and list the matter in the usual course.
