ORDER : The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences under Sections 120(B), 406, 408, 409, 420, 465, 467, 468, 471 and 477(A) read with Section 109 of IPC in Crime No.Unknown of 2024 on the file of the respondent police, seeks anticipatory bail.
2. When the matter was taken up for hearing today, the learned Government Advocate (Criminal Side), on instructions, submitted that, as on date, there is no case and no FIR has been registered against the petitioner.
3. In reply, the learned counsel for the petitioner submitted that, already surcharge proceedings have been initiated against the petitioner.
4. Therefore, if based on the instructions of the higher officials, any FIR is registered by the respondent police, they can resort to issuance of notice to the petitioner and on receipt of the same, petitioner shall cooperate with the enquiry. 2/3
5. Taking into consideration the facts and circumstances of the case and also considering the nature of the proceedings that are pending against the petitioner, as and when the FIR is registered against the petitioner, it is left open to the respondent police to proceed under Section 35 of BNSS.
6. With the above observations and directions, this Criminal Original Petition is disposed of.
