JUDGMENT

This appeal arises from the order passed by the Court of the District Judge of Kozhikode on 6.12.2005 in O.P.(Arb)No.58 of 2002, whereby the court below dismissed the application filed by the appellant under section 34 of the Arbitration and Conciliation Act, 1996 to set aside the award passed by the Arbitrator on 4.2.2002. When this appeal came up for hearing today, Sri.V.K. Balachandran, learned counsel appearing for the appellant submitted that the appellant is not desirous of prosecuting the appeal any further. In the light of the aforesaid submission, this appeal is dismissed as not pressed.
