O R D E R

Petition filed under Section 439 Cr.P.C.

The petitioner is the sole accused in crime No.1973/2014 of Neyyattinkara Police Station, which has been registered for the offences under Section 302 of IPC. 2.

The allegation is that on 4.12.2014 he inflicted a stab injury on the right upper hand of the victim, who later succumbed to injuries. It is submitted that he has been in custody since 06.12.2014 and his further detention is not necessary for completion of the investigation. 3.

Heard.

The injury was inflicted on the right upper hand only. Having regard to this fact and the fact that the petitioner has been in custody since 6.12.2014, I think he may be granted bail.

In the result, this Bail Application is allowed with the following conditions:

B.A. No.8 of 2015 -21) The petitioner will be released on bail on his executing a bond for Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate concerned.

2) He shall appear before the Investigating Officer between 10.30 a.m. and 11 30. a.m. on 1st and 3rd Saturdays for 4 months; or till the final report is filed, whichever is earlier.

3) He shall not influence the witnesses or intimidate them.

If he violates any of the conditions, the learned Magistrate is empowered to cancel the bail in accordance with the law.
