O R D E R
Petitioner is the 4th accused in Crime No.1162 of 2011 of Pathanamthitta Police Station registered for the offences under Sections 363, 376, 324 and 403 read with Section 34 of the Indian Penal Code.
2. The specific allegation against him is that he took the victim girl to several places in his car and he assaulted her with a stick and thus he helped the other accused in committing the offences.
3. Learned counsel for the petitioner submits that the petitioner has been in custody since 13.12.2013 and his further detention is not necessary for effective investigation.
4. Heard both sides.
5. The learned Public Prosecutor submits that the second accused is still absconding and if the petitioner is released on bail, his apprehension may be difficult. Other accused have already been arrested.
5. It appears that the role played by the 4th petitioner is not as serious as the role played by the other accused. His further detention is not required for completion of the investigation.
B.A. No.14 of 2015 In the result, the application is allowed.
1. The petitioner shall be released on bail after interrogation on his executing a bond for Rs.25,000/- (Rupees Twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate concerned.
2. Petitioner shall appear before the investigating officer between 10.00 a.m. and 11.00 a.m. on every Friday for three months, or till the final report is filed, whichever is earlier.
3. He shall not leave the jurisdiction of the Sessions Court concerned except with the previous permission of that Court.
4. He shall not intimidate or attempt to influence the witnesses, nor shall he destroy or attempt to destroy the evidence or interfere with the investigation.
5. If the petitioner violates any of the above conditions, the court concerned is empowered to cancel the bail in accordance with the law.
