Petitioner is the accused in Crime No.415/2014 of Kumbla Police Station registered for the offence punishable under Section 20(b)(ii)(C) of the NDPS Act.

The allegation against the petitioner is that on 12.08.2014 he was found in possession of 2.700 Kgs. of charas in contravention of the provisions of the NDPS Act, 1985. He has been in custody for the period from 12.08.2014 onwards.

Heard learned counsel for the petitioner and the learned Public Prosecutor.

The learned Public Prosecutor has pointed out that the petitioner is a habitual offender involved in a series of serious criminal cases in State of Kerala, Tamil Nadu as
BA.20/2015 : 2 :
well as Karnataka. It seems that he is accused in 8 other criminal cases involving offences under Sections 302 IPC, 307 IPC, 380 IPC, 153 IPC, etc. Considering the serious criminal background of the petitioner and the seriousness of the allegations against the petitioner in this case, I am of the view that the petitioner is not entitled to be enlarged on bail.
