O R D E R
Petitioner is the first accused in Crime No.545 of 2014 of Kumbala Police Station registered for the offences under Sections 341, 302 and 506(ii) read with Section 34 of the Indian Penal Code.
2. It is submitted that he has been in custody since 3.11.2014 and his co-accused have already been released on bail and he also may be granted bail.
3. Heard both sides.
4. The petitioner and the co-accused were arrested and remanded to judicial custody on 3.11.2014. By the order passed in Bail Application No.9123 of 2014, the co-accused were granted bail. The prayer of the petitioner was rejected on the ground that he is involved in three other cases.
5. Having regard to the fact that he has been in custody since 3.11.2014, I think he may be granted bail with stringent conditions. In the result, the application is allowed.
1. The petitioner shall be released on bail after interrogation on his executing a bond for Rs.1,00,000/- (Rupees One lakh only) with two solvent
B.A. No.105 of 2015 sureties each for the like sum to the satisfaction of the learned Magistrate concerned.
2. He shall not enter the revenue district of Kasaragod except for compliance with the conditions in this order.
3. Petitioner shall appear before the investigating officer between 02.00 p.m. and 03.00 p.m. on every Thursday for four months, or till the final report is filed, whichever is earlier.
4. He shall not intimidate or attempt to influence the witnesses, nor shall he destroy or attempt to destroy the evidence or interfere with the investigation.
6. If the petitioner violates any of the above conditions, the court concerned is empowered to cancel the bail in accordance with the law.
