O R D E R

Petition filed under Section 439(1) Cr.P.C.

2. Petitioner is the 1st accused in Crime No.2228 of 2014 of Pathanamthitta Police Station registered for the offence under Section 379 read with Section 34 of the Indian Penal Code.

2. The allegation is that he committed theft of 4 ducks. It is submitted that considering the period of custody, he may be granted bail.

3. Heard both sides.

4. Having regard to the nature of the allegation and the fact that the petitioner has been in custody since 27.12.2014, I am inclined to grant him bail which will not affect the investigation. In the result, the application is allowed.

1. The petitioner shall be released on bail on his executing a bond for Rs.25,000/- (Rupees Twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of the learned Magistrate concerned.

2. Petitioner shall appear before the investigating officer

B.A. No.142 of 2015 between 10.30 a.m. and 11.30 a.m. on every second Saturday for four months, or till the final report is filed, whichever is earlier.

3. If the petitioner violates any of the above conditions, the court concerned is empowered to cancel the bail in accordance with the law.
