Petition filed under Section 438 Cr.P.C.
The petitioner is the accused in crime No.20/2015 of Peruvanthanam Police Station registered for the offence under Section 20 (b) of the NDPS Act.

The allegation is that he was found growing two ganja plants in his property. The learned counsel for the petitioner submits that they grew spontaneously and the petitioner had nothing to do with it.

The learned Public Prosecutor submits that the ganja plants were seen grown in sacks. This is a clear indication that they were intentionally grown. This is not a fit case anticipatory bail.
In the result, this application is dismissed. Learned counsel for the petitioner submits that the
B.A. No.505 of 2015 -2petitioner will surrender before the Investigating Officer. He may do so if he is so advised.
