Petition filed under Section 439 Cr.P.C.

Petitioner is the 4th accused in Crime No.2675/2014 of the Kayamkulam Police Station, registered for the offences punishable under Sections 120 (B), 392 and 397 read with Section 34 of the Indian Penal Code.

The allegation against the petitioner and the other accused is that on 07.10.2014 at 7.45 p.m., they came in front of the shop of the defacto complainant by a motorbike and asked for cigarette to the defacto complainant. When she turned to take the cigarette, the 1st accused snatched away her gold chain weighing 51/2 sovereigns from her neck. When the husband of the defacto complainant intervened to
B.A.No. 522 of 2015 -: 2 :- prevent the same, he was attacked and a cut injury was inflicted on his right hand muscle with a sword. Petitioner has been in custody for the period from 14.11.2014 onwards.

Heard learned counsel for the petitioner and the learned Public Prosecutor. Perused the CD.

It has come out the petitioner is involved in four other criminal cases also. Final report has already been filed in the matter. It seems that the petitioner is a dare criminal involved in a series of serious criminal cases. Considering the seriousness of the allegations against the petitioner, and the serious criminal antecedents on his part, I am of the view that the petitioner is not entitled to be enlarged on bail.
