Petition filed under Section 438 Cr.P.C.

Petitioner apprehends he will be arrested by the police on the accusation that he has committed the offence under Sections 13(1) (C) r/w 13(2) of the Prevention of Corruption Act and Section 409 IPC. 3.

He was Headmaster of a school. It is alleged that he misappropriated certain amount and forged some documents. 4.

Heard.

Learned Public Prosecutor submits that the case has been entrusted to CBCID and the petitioner need not apprehend arrest now. In the light of the above submission I am inclined to dispose of this application with a direction to the investigating officer to issue notice to the petitioner under Section 41A Cr.P.C if the circumstances warrant it.
