Petition filed under Section 438 Cr.P.C.
2. According to the petitioners they are apprehending arrest in connection with Crime No.3 of 2015 of the All Women Police Station, Thallakulam, registered for the offences punishable under Section 498A, 406 and 506(i) of the Indian Penal Code and Section 4 of the Tamil Nadu HW Act.
3. It seems that the allegation against the 1st petitioner is that he had married the defacto complainant woman in Tamil Nadu by garlanding her at a temple as per Hindu rites and customs. According to the 1st petitioner, he is a Christian and the said marriage is not valid at all. It has come out that the parties had resided together as husband and wife at several places. Considering the facts and circumstances, I am of the view that this is a fit case wherein interim anticipatory bail can be granted to the petitioners for one month for enabling them to approach the High Court of
B.A. No.769 of 2015 Madras or the concerned High Court for anticipatory bail. In the result, this bail application is allowed and during a period of one month from today, the investigating officer or such other police officer, who is conducting the arrest of the petitioners, is directed to enlarge the petitioners on bail in the event of their arrest on each of them executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties for the like sum each to the satisfaction of the officer conducting arrest.
