Petition filed under Section 438 Cr.P.C.

2. Petitioner is alleged to have committed the offences under sections294(b), 324 and 326 of IPC.

3. The prosecution case is that he uttered obscene words and assaulted the victim with a stone causing loosening of teeth.

4. Heard .

5.The prosecution documents prima facie, reveal commission of the offences by the petitioner. Some teeth of the victim were found lose as a result of the attack. Moreover, learned Public Prosecutor submits that the victim lost one tooth. This is not a fit case to invoke the jurisdiction of this Court under section 438 Cr.P.C.
