ORDER

Petition under Section 438 Cr.P.C.

Petitioner is the accused in Crime No.2300/2014 of Kalady Police station registered for the offences punishable under Sections 406 and 420 of the I.P.C.

It is alleged that the petitioner is the Director of a chitty company in which the defacto complainant has participated in a chitty as a subscriber. It is alleged that even though an amount of ₹17,000/- was received from the defacto complainant by the petitioner by way of subscriptions in the chitty, the chitty was terminated prematurely and the amount was not repaid. 4.

Heard learned counsel for the petitioner and learned

5. The learned counsel petitioner submits that the petitioner is ready and willing to deposit the amount of ₹17,000/- involved in this case. When the petitioner is ready and willing to deposit the amount involved in the case, this court is of the view that this is a fit case wherein anticipatory bail can be granted to the petitioner. 5.

In the result, this bail application is allowed and the investigating officer or such other police officer, who is conducting the arrest of the petitioner, is directed to enlarge the petitioner on bail in the event of his arrest on his executing a bond for ₹25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of the officer conducting arrest, and subject to the following terms and conditions:- (i) The petitioner shall deposit an amount of ₹17,000/- before the court below within 15 days from today.

(ii) The petitioner shall report before the

B.A.926/2015 investigating officer in between 9 a.m. and 11 a.m. on all Tuesdays and Fridays, commencing from 17.3.2015 for a period of three months or till the filing of the final report in this case, whichever is earlier.

(iii) The petitioner shall not tamper with the evidence or influence witnesses.

(iv) The petitioner shall make himself available for interrogation as and when required by the investigating officer.

(v) The petitioner shall not involve in any offence while on bail.
