Petitioner is the 2nd accused in Crime No.1119/2014 of Thumba Police Station registered for the offences punishable under Sections 294(b), 324, 308, 427 and 506 read with 34 IPC. It is submitted that he has been in custody since 13.1.2015 and final report has already been filed and he may be released on bail.

Heard learned counsel for the petitioner and the learned Public Prosecutor.

The learned Public Prosecutor submits that since the final report has already been filed, bail may not be granted. The learned Public Prosecutor also submits that the co-accused is also in custody, the co-accused is involved in several cases. But the petitioner is not involved in any other case. So I am inclined to grant him bail.

B.A.NO1010/2015 5.

In the result, this Bail Application is allowed and the petitioner shall be released on bail on his executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum to the satisfaction of the Magistrate concerned.

He shall not intimidate or attempt to influence witnesses.

He shall not leave Thiruvananthapuram District except with the previous permission of the court concerned.

He shall surrender his passport, if any, before the learned Magistrate within seven days of his release. If he does not have one, he shall file an affidavit to that effect within the said period.
