Petition under Section 438 Cr.P.C.

According to the petitioner, he is apprehending arrest in connection with Crime No.165/2015 of the Valanchery Police Station, Malappuram.

Heard the learned counsel for the petitioner and the learned Public Prosecutor. The learned Public Prosecutor has pointed out that the petitioner has not been so far arraigned as an accused as the accused has not been identified. Matters being so, there need not be any apprehension of arrest at present. In case, the police wants to arrest the petitioner in connection with the present crime, he shall be given an opportunity to approach this Court once again under Section 438 Cr.P.C.
