Petition filed under Section 439 Cr.P.C.
2. The petitioner is the 5th accused in Crime No.47 of 2006 of C.B.C.I.D., Kozhikode, registered for the offences punishable under Sections 143, 147, 148, 341, 304, 363, 307, 395, 302 and 407 read with Section 149 of the Indian Penal Code and Section 120B of the Indian Penal Code.
3. Altogether there were 12 accused in the case. During the course of investigation, the petitioner was absconding and he was somewhere in Tamil Nadu. It seems that he has surrendered before court on 18.07.2014 and thereafter he has been in custody.

Heard learned counsel for the petitioner and the learned Senior Public Prosecutor.
5. It seems that the petitioner has been absconding
B.A.No.1095 of 2015 -: 2 :- for more than 8 years. Presently, some of the accused in the case were convicted and sentenced, on which appeals are pending before this Court. All the original prosecution records are pending in the said cases, which are ripe for hearing. Now the prosecution has obtained certified copies of all the prosecution documents and the same are being produced before the court below. There will not be any hindrance to the continued trial of the case as documents are being produced. Matters being so, this is not a fit case, wherein the petitioner can be enlarged on bail, at present. With a direction to the Court below to dispose of the case as expeditiously as possible, this bail application is dismissed.
