ORDER
This application for pre-arrest bail is filed by the first accused in Crime No.55 of 2015 of the Pudunagaram Police Station for offences punishable under Sections 341, 323, 354, 452 and 506(ii) r/w Section 34 of the Indian Penal Code. 2.
The allegation of the prosecution is that there was a previous incident in which the accused allegedly manhandled the husband of the de facto complainant whereupon he lodged a complaint to the police. As a retaliation, it is alleged that on 14.01.2015, the accused trespassed into the house of the de facto complainant and assaulted her. When the husband intervened, he was also allegedly assaulted. FIS was laid, whereupon the present crime was registered. Apprehending arrest, the first accused seeks pre-arrest bail.

Heard and examined the records.

Evidently, no serious injuries are caused to the de facto complainant and her husband. Though the conduct of the accused cannot be lightly seen, no weapon is also used. Considering these
B.A.1167/15 facts, the benefit of pre-arrest bail can be granted to the petitioner, since I feel that custodial interrogation of the petitioner does not appear to be essential in this case. Hence, I am inclined to grant bail to the applicant subject to the following conditions: (i) Applicant shall appear before the Investigating Officer on 22.07.2015 between 9 a.m and 10 a.m.
After undergoing interrogation, in the event of his arrest, he shall be released on bail on executing a bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties for the like sum each.
(ii) He shall not interfere in the process of investigation, threaten, coerce or intimidate the witnesses.
(iii) He shall appear before the Investigating Officer as and when called for. The application is allowed accordingly.
