Petition filed under Section 439 Cr.P.C.

2. The petitioner is the accused in Crime No.11 of 2015 of the Kumbla Excise Range, registered for the offences punishable under Sections 58 and 67B of the Abkari Act.

3. The allegation against the petitioner is that on 20.02.2015 at 8.15 a.m., he was found transporting 24 bottles each containing 180 ml of Indian Made Foreign Liquor and 24 bottles each containing 500 ml of beer by

B.A.No.1225 of 2015 -: 2 :- Scooter bearing registration No.KA-19-W-7565, in contravention of the provisions of the Abkari Act. The petitioner has been in custody for the period from 20.02.2015 onwards.

Heard learned counsel for the petitioner and the learned Public Prosecutor.

5. The learned Public Prosecutor has pointed out that the petitioner is involved in another crime of similar nature. Considering his similar criminal antecedent and the quantity of the contraband involved in this case, I am satisfied that he is not entitled to be enlarged on bail.
