Petitioner is the first accused in Crime No.1814/2014 of the Pudukkad Police Station, registered for the offences punishable under Sections 143, 147, 148, 341, 323, 324, 326, 506(ii) and 308 read with Section 149 of the Indian Penal Code and Section 27 of the Arms Act. 3.
The allegation against the petitioner and the other accused is that on 09.10.2014 at 7.15 a.m., they formed themselves into an unlawful assembly armed with deadly weapons like swords, iron rods, knife etc. and came by a 'Swift Dzire Car' and attacked the defacto complainant. It is
B.A.No. 1240 of 2015 -: 2 :- alleged that the petitioner inflicted a very serious cut injury on the back of the defacto complainant with the sword. Further, he inflicted another serious cut injury on the head of one Santhosh who was also present with the defacto complainant. The 2nd accused stabbed one Sreelal, who was also present along with the defacto complainant, with a knife. The 3rd accused beat Santhosh with an iron rod thereby causing fracture of the bone on his left knee. The other accused persons slapped, kicked and stamped the defacto complainant and the other injured persons. Petitioner has been in custody for the period from 05.01.2015 onwards. His arrest was formally recorded while he was undergoing detention in another case.

Heard learned counsel for the petitioner and the learned Public Prosecutor. Perused the CD.

The learned Public Prosecutor has reported that the petitioner is accused in Crime No.95/2012 of the Kattoor Police Station, Crime No.1211/11 of Vadanappally Police
B.A.No. 1240 of 2015 -: 3 :- Station, Crime No.1725/2011 of the Kodungallur Police Station, Crime No.930/2014 of the Kalpetta Police Station and Crime No.1420/2014 of the Nenmara Police Station. One of the above cases is one of dacoity. Considering the series of serious criminal antecedents on the part of the petitioner and the seriousness of the allegations levelled against the petitioner, I am of the view that the petitioner is not entitled to be enlarged on bail in a case like this.
