ORDER

Petition filed under Section 438 Cr.P.C.

2. This case was registered for the offences under Section 365 IPC and Sections 7 and 8 of the Protection of Children from Sexual Offences Act. The allegation is that the first accused kidnapped a girl aged 16 years and the petitioner and the other co-accused helped him to conceal her.

3. Heard.

4. It is submitted that the first accused has already been arrested. The allegation against the petitioner is that he only helped the first accused to conceal the victim. I am satisfied that custodial interrogation of the petitioner is not necessary for effective investigation.

In the result, this application is allowed.

B.A. No. 1323 of 2015 1) The petitioner shall be released on bail after interrogation on his executing a bond for Rs. 25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum if he is arrested by the Police in connection with this case.

2) He shall appear before the Investigating Officer for interrogation if he is so required by him in writing.

3) He shall not destroy or tamper with evidence.

4) He shall not harass the defacto complainant. In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with the law.
